Terms of Service

1. Acceptance of Terms
By accessing or using the Prevly platform ("Service"), operated by Prevly ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Prevly provides an AI-powered predictive maintenance platform that:
- Ingests sensor data from industrial equipment via IoT protocols (MQTT, OPC-UA, Modbus)
- Detects anomalies using machine learning models (LSTM, Isolation Forest, TranAD)
- Predicts remaining useful life (RUL) with confidence intervals
- Classifies faults with Integrated Gradients attribution
- Generates alerts and integrates with CMMS/ITSM systems
3. Accounts & Access
- You must provide accurate registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of unauthorized access
- One account per person; accounts are non-transferable
- We may suspend accounts that violate these terms
4. Subscription & Billing
- Pricing: Per-machine monthly billing as displayed on our pricing page
- Free trial: 14 days, up to 10 machines, no credit card required
- Payment: Processed securely via Stripe. You authorize recurring charges
- Cancellation: Cancel anytime via account settings. Access continues until end of billing period
- Refunds: Pro-rated refund available within 30 days of paid subscription start
5. Your Data
- Ownership: You retain full ownership of all sensor data, configurations, and derived insights uploaded to or generated by the Service
- License to us: You grant us a limited license to process your data solely to provide the Service (ML inference, storage, visualization)
- Isolation: Your data is isolated from other tenants via row-level security. We never use your data to train models for other customers
- Export: You can export your data at any time via API or by contacting support
- Deletion: Upon account termination, your data is deleted within 30 days
6. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or disassemble the Service
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to other tenants' data
- Exceed rate limits or abuse API endpoints
- Resell access to the Service without written permission
7. ML Predictions & Disclaimers
Predictions are advisory, not deterministic.Prevly's ML models provide probabilistic assessments based on historical patterns. They do not guarantee that equipment will or will not fail at any specific time.
- Always follow your organization's safety procedures and maintenance protocols
- ML predictions should supplement, not replace, human engineering judgment
- Model accuracy improves over time as more data is collected
- We provide confidence intervals (P10/P50/P90) to help you assess prediction certainty
8. Service Level Agreement
- Standard/Lite: Best-effort availability
- Enterprise: 99.9% uptime SLA with service credits for downtime exceeding the guarantee
- Scheduled maintenance: Announced 48 hours in advance, performed during low-usage windows
9. Limitation of Liability
To the maximum extent permitted by law, Prevly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, equipment damage, production losses, or data loss arising from use of or inability to use the Service.
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Intellectual Property
- The Service, including its ML models, algorithms, UI, and documentation, is owned by Prevly
- Your data and any custom models trained on your data belong to you
- "Bring Your Own Model" (BYOM) uploads remain your intellectual property
11. Termination
Either party may terminate the agreement with 30 days written notice. We may terminate immediately for material breach. Upon termination, you may export your data within 30 days, after which it will be permanently deleted.
12. Governing Law
These Terms are governed by the laws of the European Union and the member state in which Prevly is incorporated. Disputes shall be resolved through binding arbitration in accordance with ICC rules, or in the courts of competent jurisdiction.
13. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
